What is a W-8BEN form and how do I fill it out?

Legacy Global has many clients that recommend recipients or vendors based outside the United States to provide services or receive grants. In order to maintain transparency with the IRS, we may require a foreign individual to fill out the W-8BEN form. 

The W-8BEN is a form used by the IRS to collect tax information for individuals based in the United States of America.  There are only three parts required to fill on this form.

Part One

The individuals name, country of citizenship, address information and tax identification number are all included in the first part of the form. If you do not live in your country of citizenship, enter the country in which you are a resident. Those who hold U.S. citizenship should not be filing this form.

Part Two

The foreign country that the individual resides in must be listed along with any restrictions or conditions. This may vary with different countries and their tax treaty with the United States.

Part Three

Signing this form signifies that all the information is true, correct and complete. Once this certification has been completed, the form is ready for submission!
